Welcome to https://www.gte.travel. This “User Agreement and Terms of Use” describes the terms and conditions applicable to your access and use of the website: https://www.gte.travel, the “Site”. This document is a legally binding agreement between you as the user(s) of the Site (hereinafter referred to as “you”, “your”, "Client" or “User”, which collectively refer to Client and/or any of its employees) and Dubai Link Tours LLC, the Owner of the Site (hereinafter referred to as “we”, “our”, “Dubai Link”, or “GTE®”).

 

This User Agreement and Terms of Use, and all policies and additional terms posted on and in the Site, collectively referred to herein as Terms of Use (TOU) set up the terms and conditions based on which GTE® offers you access to and use of our Services, definition of which is given herein below. All policies and terms are incorporated into this TOU. The terms and conditions of the TOU form an integral part of the website and cannot be separated from the general contracting conditions, operations or reservations. By accessing and using this Web Site, you agree to be bound by all terms and conditions contained and/or referenced herein, along with all applicable laws and regulations set forth on this Site. You agree to comply with all of the terms and conditions of the TOU the moment you click on the ACCEPT button herein below to access or use our Services.

1. ACCEPTANCE OF TERMS

The Services that GTE® provides to User are subject to the following Terms of Use ("TOU"). GTE® reserves the right to update the TOU at any time without notice to User. The most current version of the TOU can be accessed each time user logs into the Site to use our Services, or reviewed by clicking on the "Terms of Use" hypertext link located at the bottom of the Site homepage.

A. The permission granted by GTE® to Client to use the Site is restricted to Client and is not transferable to any other person or entity. Client is responsible for all use of User's Account (under any screen name or password) and for ensuring that all use of User's Account complies fully with the provisions of the TOU. Client shall be responsible for protecting the confidentiality of User's password(s).

B. GTE® shall have the right at any time to change or discontinue any aspect or feature of the Site, including, but not limited to, content, hours of availability, and equipment and/or systems needed for access or use.

 

A. GTE® reserves the right at any time to change or modify the terms and conditions applicable to User's use of the Site, or any part thereof, or to impose new conditions. GTE® also reserves the right at any time to change, modify, substitute, suspend or remove any content, information, service, or the format thereof from time to time without notice. Furthermore, GTE® reserves the right to terminate or restrict access to the Web Site for any reason whatsoever at its sole discretion. Such changes, modifications, additions or deletions shall be effective immediately upon posting on the Site. Any use of the Site by User after posting the new TOU shall be deemed to constitute acceptance by User of such changes, modifications or additions.

B. User is requested to approve our TOU each and every time User logs into the Site to use our Services, which will be accessible via a secure pop-up window. User is urged to read and either accept or decline TOU. User acknowledges that User will not be able to access our Services unless User accepts the TOU.

C. It is User’s sole responsibility to contact GTE® and request User’s account be closed and deleted.

 

A. GTE® is a business to business (B2B) company and does not serve or deal with end consumers. Should a Guest have any queries pertaining to a booking, Client who has made the booking shall be liable toward Guest. As a B2B company, GTE® does not solicit inquiries from end consumers. GTE® is not responsible in any manner and under any circumstances for any loss, damages, fines, penalties, fees, or payments of any kind that may incur as a result of a booking made via Client.

B. Through its Web property, GTE® provides User with access to a variety of resources, including, but not limited to, travel services, browsing of travel services and service suppliers and providers, download areas, and product information, referred to collectively herein as "Services". The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to the TOU. For clarity, service suppliers and providers shall refer, without limitation, to suppliers and providers of travel services, such hotels, hotel chains, distributors, car rentals and any and all service providers.

C. The Services comprise all travel services, including, but not limited to, hotel reservations, purchase and issuance of air tickets and itineraries, car rentals, dinner reservations, purchase of theater tickets, frequent flyer reservations, canceling, changing and rescheduling of reservations, photo albums, and/or any other facilities designed to enable User to purchase the Services.

D. Cancellation and amendment charges are payable if a service is cancelled or amended as per a given time-frame or as stipulated by the service suppliers and providers.

C. User agrees to use the Site to make purchases of the Services. By way of example, and not as a limitation, User agrees that when using the Site, User SHALL NOT:

(i) Use any material or information, including images or photographs, which are made available through the Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.

(ii) Falsify or delete any copyrighted content or any notices related to the Services or proprietary designations of the origin or source of material contained on or via the Site.

(iii) Violate any applicable laws or regulations.

(iv) The foregoing provisions are for the benefit of GTE®, its subsidiaries, affiliates and its third party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or via GTE®.

 

A. Use of the Services is contingent to having an account with GTE®.

B. Client undertakes to inform GTE® of any updates to Client’s account, including, but not limited to, business legal status, compliance officer’s contact details, and Client users’ names, contact details and level of authorization granted to them by Client.

C. User is entirely responsible for maintaining the confidentiality of User’s password and account.

D. User is entirely responsible for and is held liable for any and all activities that occur under User’s account.

E. GTE® shall have the right to request the Client to furnish substantial evidence demonstrating that the bookings initiated through GTE® booking system are indeed bonafide bookings. In cases where GTE® reasonably suspects that a booking lacks bona fides, and the Client fails to rebut this suspicion, GTE® reserves the prerogative to decline the booking request or annul a previously confirmed booking. Acting judiciously, GTE® also retains the authority to cancel bookings that appear to be speculative or made in bad faith, unless the Client substantiates their legitimacy with adequate evidence. Furthermore, GTE® reserves the discretion to cancel any booking associated with an unverified or fictitious guest name.

F. In case GTE® discovers or has reason to believe that, at any time during or after receiving a request for Services, operation is either unauthorized or the information provided by User is not correct or that any fact has been misrepresented, GTE® at its sole discretion shall have the unrestricted right to take any step against User, including cancellation of the bookings, etc. without prior warning. In such event, GTE® shall not be held responsible or liable for any loss or damage that may be caused to User, Guest, or any third party, as a consequence of such cancellation of booking or Services.

G. Notwithstanding User is liable for all activities conducted via User account, User undertakes to notify GTE® immediately of any unauthorized use of User’s account or any other breach of security.

H. GTE® shall not be liable for any damages of loss, including, but not limited to, profits, revenue, data, Client’s reputation, or otherwise, that may incur as a result of breach of User’s account, either with or without User’s knowledge. However, Client shall be held liable for losses incurred to GTE® or any third party due to breach of User’s account.

I. Without prejudice to any of GTE®’s other rights, GTE® reserves the right to deny the access to this website and/or cancel the bookings wherever and whenever GTE® believes (in GTE®’s absolute discretion) you have breached any of the GTE®’s TOU and/or Privacy Policy.

 

GTE® does not claim ownership of the materials User uploads to the Site. However, by uploading any documentation requested by the service supplier, User is granting GTE®, its affiliated companies and service licensors, permission to use User’s uploads and input to execute the Services User plans to purchase. User’s permission to GTE®, its affiliates and service suppliers and licensors shall include the right to copy, distribute, transmit, reproduce and translate User’s uploads and input.

 

IN NO EVENT SHALL GTE® BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE WEBSITE, DOWNLOADS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICE SUPPLIERS.

 

A. USER EXPRESSLY AGREES THAT USE OF WWW.GTE.TRAVEL IS AT USER'S SOLE RISK. NEITHER GTE®, ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES WARRANT THAT WWW.GTE.TRAVEL WILL BE UNINTERRUPTED OR ERROR FREE, NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE, OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE, OR MERCHANDISE PROVIDED BY THE SERVICE SUPPLIERS VIA THE SITE.

B. WWW.GTE.TRAVEL IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF SERVICES OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.

C. THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.

D. IN NO EVENT WILL GTE® BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE. USER HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE SITE.

E. IN ADDITION TO THE TERMS SET FORTH ABOVE, NEITHER GTE®, NOR ITS AFFILIATES, SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS, INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY OF, THE INFORMATION CONTAINED WITHIN THE SITE, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE USER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES.

F. FORCE MAJEURE – NEITHER PARTY WILL BE RESPONSIBLE FOR ANY FAILURE OR DELAY IN PERFORMANCE DUE TO CIRCUMSTANCES BEYOND ITS REASONABLE CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OF GOD, WAR, RIOT, EMBARGOES, ACTS OF CIVIL OR MILITARY AUTHORITIES, FIRE, FLOODS, ACCIDENTS, SERVICE OUTAGES RESULTING FROM EQUIPMENT AND/OR SOFTWARE FAILURE AND/OR TELECOMMUNICATIONS FAILURES, POWER FAILURES, NETWORK FAILURES, FAILURES OF THIRD PARTY SERVICE SUPPLIERS (INCLUDING PROVIDERS OF INTERNET SERVICES AND TELECOMMUNICATIONS). THE PARTY AFFECTED BY ANY SUCH EVENT SHALL NOTIFY THE OTHER PARTY WITHIN A MAXIMUM OF FIVE (5) DAYS FROM ITS OCCURENCE. THE PERFORMANCE OF THIS AGREEMENT SHALL THEN BE SUSPENDED FOR AS LONG AS ANY SUCH EVENT SHALL PREVENT THE AFFECTED PARTY FROM PERFORMING ITS OBLIGATIONS UNDER THIS AGREEMENT.

 

A. THE LINKS IN THIS AREA MAY SOMETIMES REDIRECT USER TO SERVICE SUPPLIERS’ SITES. THE LINKED SITES ARE NOT UNDER THE CONTROL OF GTE® AND GTE® IS NOT RESPONSIBLE FOR THE CONTENTS OF ANY LINKED SITE OR ANY LINK CONTAINED IN A LINKED SITE, OR ANY CHANGES OR UPDATES TO SUCH SITES. GTE® IS NOT RESPONSIBLE FOR WEBCASTING OR ANY OTHER FORM OF TRANSMISSION RECEIVED FROM ANY LINKED SITE. GTE® IS PROVIDING THESE LINKS TO YOU ONLY AS A CONVENIENCE, AND THE INCLUSION OF ANY LINK DOES NOT IMPLY ENDORSEMENT BY GTE® OF THE SITE.

B. GTE® is an independent intermediary (and not a supplier) of Travel Services supplied by third parties. Accordingly, GTE® has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, reviews, statements, services, offers, or other information or content expressed or made available by third parties, are those of the respective suppliers and not of GTE®.

C. GTE® does not guarantee the accuracy beyond the warranty given by the Service Supplier. Although care has been taken to ensure the accuracy of the information on this Web Site, GTE® assumes no responsibility thereof. Information on this site is posted in good faith and updated regularly, but GTE® cannot guarantee its completeness and accuracy. GTE hereby expressly disclaims any representations or warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for any particular purpose, non-infringement, or as to the operation of this web site or the content.

D. ONLY AND ONLY WHERE GTE® CLEARLY AND PLAINLY STATES THAT GTE® ENDORSES INFORMATION OR CONTENT GTE® PUBLISHES ON WWW.GTE.TRAVEL SHALL GTE® ASSIST USER TO CONTACT THE RESPECTIVE SERVICE SUPPLIER FOR ANY CLAIMS OF LOSS OR DAMAGE INCURRED BY USING SUCH INFORMATION UPON COMPLETION OF THE PURCHASE. HOWEVER, RESPONSIBILITY OF GTE® SHALL BE LIMITED TO A REPLACEMENT OF THE PURCHASED DAMAGED OR OFF-SPECIFICATIONS SERVICE OR A REFUND OF THE MONEY PAID BY USER TO MAKE THAT PURCHASE, IN ACCORDANCE WITH THE TERMS AND PROVISIONS OF THIS AGREEMENT.

 

A. Group Bookings:

(i) Hotel Reservations at the same hotel are accepted for a maximum of 5 rooms only.

(ii) eservations for 6 rooms or more at a time are considered to be a group booking and must be executed offline via GTE®’s recognized offices.

(iii) GTE® Portal system is solely for FIT bookings. In the event Client breaches this condition by splitting groups into small individual bookings, whether under same or different guest names, this will result in cancellation of the whole group bookings by either GTE® or the Service Supplier, and Client will be charged a cancellation fee as per the booking Terms, in addition to possible administrative charges.

B. Transaction Fees:

(i) Should Client make payment of the Travel Services via bank transfer, Client shall pay for transaction fees.

(ii) In the event a transaction does not go through and/or Client has to repeat a transaction, whereby new transaction fees may apply, GTE® is free of any commitments to Client or Guest and shall not be liable to Client or Guest and/or any third party for any extra fees paid to complete the purchase of the requested Travel Services.

C. Reimbursement:

(i) Should Client or its Guest be entitled for a refund, whereby payment of the purchased Travel Services was made via a credit card or a bank transfer, refund will be made in the same manner payment was made and to the same account. Bank policies shall prevail. A refund to credit card may take up to twenty-one (21) days to appear in the account of the credit card, whereas a refund via bank transfer may take up to seven (7) days.

(ii) Should Client or Guest be entitled for any full or partial reimbursement, the party that issues the invoice shall reimburse Client in the same manner payment was made and in the same currency.

(iii) Contingent to Service Supplier’s approval, Guest (or a first-degree relative in case of Guest’s decease) may be entitled for a refund upon cancellation of booking after cancellation deadline or in the event of no show-up only in the following cases, provided that certified official documents be submitted in support of claim:

a) Death of Guest;

b) Death of Guest’s first-degree relative (parents, offspring, siblings, & spouse);

c) Act of God (hurricanes, earthquakes, etc.);

d) Terrorist attacks; &

e) Temporary or Permanent closure of destination (hotel, restaurant, car rental, etc.) due to Force Majeure (such as fire, Act of God, Government resolution, etc.).

D. Cancelation:

(i) Each and every time Client makes a purchase of the Services, it explicitly and implicitly approves all policies incorporated with the booking, including Cancelation Policy.

(ii) Unless where GTE® incorporates its cancelation policy per booking, Service Supplier’s cancelation policy that appears in the invoice or published by the Service Supplier at the time of booking shall prevail and govern any and all bookings made on the Site.

(iii) Cancellation fees shall be paid to the respective party issuing the invoice or as GTE® at its own discretion dictates..

E. Guest Complaint:

(i) GTE® shall not deal with any claims that have not been presented by the Guest during the period of stay at the accommodation.

(ii) GTE® shall not be able to negotiate any claim with the Service Supplier that is presented by Guest and/or Client after the date of Guest’s departure from the establishment in question and/or without proof. Any unsupported complaints will not be entertained.

F. Limitation of Liability:

(i) GTE acts as the agent and as an independent intermediary in the contracting of accommodation and other services, and thus shall not be held liable for death, injury, illness, damage, loss, accident, theft, delays or any other irregularity which may arise, whether directly or indirectly, from the supply of Services by the hotel or other Service Suppliers and which have been contracted via GTE®.

(ii) GTE® shall do its best to insure that all Service Suppliers it contracts with have a valid insurance policy complying with the local laws where the facility is located against any and all incidents of death, injury, illness, damage, loss, accident, theft, delays or any other irregularity which may arise, whether directly or indirectly, from the supply of Services.

 

User agrees to defend, indemnify and hold harmless GTE®, its affiliates and their respective directors, officers, and employees from and against all claims and expenses, including attorneys' fees, arising out of User’s use of the Site.

 

GTE®’s logos are trademarks of GTE®, all rights reserved. All other trademarks appearing on the Site are the property of their respective owners.

 

A. This site has security measures in place to protect the loss, misuse and alteration of the information under our control. We use SSL encryption to ensure the privacy of the information provided to us and at no time are your debit/credit card details transmitted decrypted over the Internet

B. To further protect the information you share with us we have an exhaustive security system that includes world class firewall technologies; logical network segmentation to allow restricted access to stored profile information and logical and physical security restrictions to our databases and systems. Whilst SSL encryption is used to protect sensitive information online we also do everything in our power to protect User information off-line.

C. All your information is restricted in our offices and only employees who need the information to perform a specific job are granted access to personally identifiable information.

D. All employees are kept up-to-date on our security and privacy practices with regular quarterly updates or whenever new policies are added.

 

A. GTE® understands and respects the importance of your privacy. We do not collect personal information about you or about Guests. The only way we will get any kind of personal information is if you give it to us when we specifically ask for it for the purpose of completing the purchase of a booking.

B. We ask you for personal information in a variety of circumstances:

(i) when you make a reservation or purchase a service via our website or through our customer service team - by email, letter, fax, or on the phone;

(ii) when you register with us, subscribe to our newsletter, enter competitions or register for promotions; &

(iii) when you take part in surveys or provide us with feedback.

C. When you provide information through the site you will be providing it to GTE®. You should be aware that it may be accessed from countries whose laws provide various levels of protection for personal data, not always equivalent to the level of protection that may be provided in your own country.

D. We use your Internet Protocol [IP] address to help diagnose problems with our server and/or to administer our Web site.

E. We will not pass on any information about you or your Guest to any third party without your prior permission or your Guest’s prior permission, unless it is to execute a booking you have made with us.

 

A. Your use of the Site will be governed by and construed in accordance with the laws of the United Arab Emirates and any disputes will be decided by the courts of Dubai, United Arab Emirates.

Any rights not expressly granted herein are reserved.
